Overview
These Terms and Conditions govern your access to and use of KlickPay services, including the website, payment gateway, merchant services, hosted payment pages, plugins, APIs, integrations, applications and related solutions.
By accessing, installing, integrating or using any part of the service, you agree to these terms and to applicable laws and regulations of the State of Kuwait.
1. Acceptance of Terms
- Your use of KlickPay constitutes your acceptance of these Terms, as updated from time to time.
- If you use the service on behalf of a company or merchant, you represent that you are authorized to bind that entity.
- You are responsible for ensuring that your use of the service complies with all applicable legal, regulatory, contractual and operational requirements.
2. User Obligations
- Provide accurate, complete and current information when required.
- Maintain confidentiality of account credentials, API credentials, tokens and integration keys.
- Use the service only for lawful and authorized purposes.
3. Services and Payment Processing
KlickPay provides digital payment and transaction-related services to merchants, businesses and users through direct services and technical integrations.
- Transactions may be processed through banks, acquirers, payment schemes, payment channels or authorized third-party providers.
- KlickPay may decline, suspend, investigate, delay or reject any transaction where required for security, fraud prevention, compliance, technical or legal reasons.
- Transaction processing remains subject to applicable banking rules, issuer/acquirer decisions, scheme rules and legal restrictions.
4. Merchant Integrations, Plugins, APIs and Checkout
KlickPay may support integrations through merchant websites, e-commerce systems, plugins, applications, APIs, hosted payment pages and other technical methods.
When such integrations are used, the merchant authorizes KlickPay to receive and process information reasonably required to create, route, validate, complete, reconcile and support the transaction.
5. Fees, Refunds and Chargebacks
- Applicable service fees, transaction charges or third-party payment channel fees may apply according to the relevant merchant agreement, pricing arrangement, service plan or transaction flow.
- Refunds, reversals and chargebacks are subject to merchant terms, payment channel rules, banking requirements, internal validation and operational feasibility.
- KlickPay may require supporting records or merchant confirmation before acting on refund-related requests.
6. Compliance and Prohibited Use
You must not use KlickPay for unlawful, fraudulent, misleading, abusive or unauthorized activities, or for products or services prohibited by applicable law, regulation, sanctions requirements, payment channel rules or internal risk controls.
7. Data Privacy and Protection
KlickPay handles personal and transaction-related information in accordance with its Privacy Policy and applicable legal and regulatory requirements.
8. Liability, Suspension and Amendments
- To the maximum extent permitted by law, KlickPay is not liable for indirect, incidental, special, punitive or consequential damages arising from use of the service.
- KlickPay may suspend, limit or terminate access where necessary for security, fraud prevention, legal compliance, operational integrity, technical protection or misuse.
- KlickPay may update these Terms from time to time. Continued use after updates constitutes acceptance.
9. Governing Law
These Terms are governed by the laws of the State of Kuwait. Any dispute arising out of or in connection with these Terms or the service shall be subject to the jurisdiction of the competent courts of the State of Kuwait, unless otherwise required by applicable law or binding regulatory requirement.
